Die Teilnahme an Gewinnspielen der Swafing GmbH richtet sich nach den folgenden allgemeinen Bedingungen:
Teilnahmebedingungen für Gewinnspiele von Swafing GmbH, Bentheimer Str. 175-179, 48529 Nordhorn.
Mit der Teilnahme am Gewinnspiel erkennt der Teilnehmer die nachfolgenden Teilnahmebedingungen an:
1) Der Zeitraum für die Teilnahme am Gewinnspiel ist unmittelbar der entsprechenden Gewinnspielseite zu entnehmen.
2) Die Preise sind der jeweiligen Gewinnspielseite zu entnehmen.
3) Die Teilnahme erfolgt über einen Kommentar im Gewinnspielbeitrag. Es darf nur ein Kommentar pro Person abgegeben werden.
4) Jeder Teilnehmer räumt dem Veranstalter Swafing GmbH das Recht ein, den Namen des Gewinners zu veröffentlichen, unabhängig davon in welchen Medien on- und offline.
5) Zur Teilnahme berechtigt sind natürliche Personen ab 18 Jahren. Von der Teilnahme ausgeschlossen sind Mitarbeiter von Swafing GmbH und deren Angehörige.
6) Die Gewinner werden innerhalb 8 Tagen nach Gewinnspielende nach dem Zufallsprinzip aus allen Teilnehmern ermittelt und über das zum Kommentieren verwendete Facebookprofil oder Instagramprofil oder die verwendete eMailadresse benachrichtigt und dürfen auch in einem öffentlichen Beitrag im Blog, auf der Facebookseite und bei Instagram genannt werden. Die Gewinner müssen sich innerhalb von 4 Werktagen nach Versand der Gewinnbenachrichtigung mit ihren Adressdaten bei Swafing durch Senden einer privaten Nachricht bei Facebook oder bei Instagram oder per Mail an blog@swafing.de melden. Anderenfalls wird der Preis unter allen Teilnehmern erneut ausgelost, die sich dann jeweils auch wieder innerhalb von 4 Werktagen nach Versand der Gewinnbenachrichtigung melden müssen.
7) Der Gewinn ist weder austausch- noch übertragbar. Die Barauszahlung und der Rechtsweg sind ausgeschlossen. Sollte Swafing GmbH aus nicht vertretbaren Gründen den Gewinn nicht zur Verfügung stellen können, behalten wir uns vor, einen gleichwertigen Ersatz zu liefern.
8) Zur Gewinnermittlung werden die Namen der Teilnehmer erfasst und gespeichert. Wir geben keine Daten an Dritte weiter.
9) Unzulässig sind Kommentare, Fotobeiträge oder Inhalte, welche Beleidigungen oder persönliche Angriffe enthalten, Werbung für ein anderes Produkt beinhalten, gegen geltendes Recht (insbesondere das Urheberrecht) verstoßen, jugendgefährdende, pornografische oder rassistische Aussagen treffen oder gegen die Facebookrichtlinien verstoßen. Solche Fotos werden vom Gewinnspiel ausgeschlossen.
10) Diese Aktion steht in keiner Verbindung zu Facebook und Instagram und wird in keiner Weise von Facebook oder Instagram gesponsert, unterstützt oder organisiert. Der Empfänger der von den Teilnehmern bereitgestellten Daten ist nicht Facebook, sondern der Betreiber. Die bereitgestellten Adressdaten werden lediglich für die Kontaktierung des Gewinners und die Verwaltung des Gewinns verwendet. Fragen, Anregungen und Beschwerden sind daher ausschließlich an den Betreiber zu richten. Darüber hinaus darf der Betreiber den Teilnehmer per E-Mail oder privater Nachricht kontaktieren.
11) Technische oder sonstige Probleme, die außerhalb des Einflussbereichs stehen, unterliegen nicht der der Haftung durch den Betreiber.
12) Ausschließlich anwendbares Recht ist das Recht der Bundesrepublik Deutschland. Sollten einzelne Bestimmungen dieser Teilnahmebedingungen ungültig sein oder werden, bleibt die Gültigkeit der übrigen Teilnahmebedingungen unberührt.

Participation in Swafing giveaway contests are contingent upon the following terms:
Contest eligibility requirements for Swafing Fabrics, Swafing GmbH („the organiser“), Bentheimer Str. 175-179, 48529 Nordhorn, Germany
By participating in the contest, the participant recognizes and accepts unconditionally the following eligibility requirements and terms:
1) The duration of contest is the fixed time period indicated in the contest announcement.
2) The prizes are limited to the items indicated in the contest announcement.
3) Entry is done through posting a comment on the Swafing blog, the official Swafing Facebook page or Instagram account. Only one comment/entry per person allowed.
4) Every participant grants the organiser, Swafing GmbH, to announce publicly the winner of the contest, regardless of media.
5) Only natural persons over the age of 18 years may participate. Employees of Swafing GmbH and their families are excluded from participating in the contest.
6) Winners shall chosen at random and be notified via electronic mail per the email address associated with the contestant’s Facebook or Instagram account within eight days after the close of the contest. In order to redeem their prizes, the winners must notify Swafing GmbH at blog@swafing.de or via the Facebook or Instagram messaging services within four business days after the sending of the winning announcement email. If confirmation is not received within this time period, the prizes shall be awarded to other contest entrants similarly chosen at random. Four business days to confirm receiving notification applies to all following contest winners as well.
7) Prizes are neither substitutable nor transferrable. Cash in lieu and legal recourse are herewith precluded. Should Swafing GmbH not be able for reasonable cause to provide the prize, Swafing GmbH reserves the right to substitute the prize with an item of equal value.
8) For the announcement of the winners, all images, Facebook names, Instagram names and/or blog and Web site addresses and links will be recorded and stored. We do not share information with third parties.
9) Comments and content, which contain insults or personal attacks, advertising for other products, violate current law (especially copyright law), are harmful to youth, contain pornographic, inciting and/or racist statements and/or imagery, and/or violate the Facebook policies and guidelines are ineligible. Such comments/entry will be excluded from the contest at the full discretion of the contest organizers.
10) This promotion is not done in association with Facebook and/or Instagram and is in no way sponsored, organised or endorsed by Facebook and/or Instagram. The recipient of the information is not Facebook, but rather the organiser. The furnished information will be used only to contact the winner and for administrative purposes for execution of the contest. Therefore, questions, comments and complaints are to be directed only to the organiser. In addition, the organiser is permitted to contact the participant by electronic mail.
11) The organiser shall not be liable for any technical or other problems, which are beyond its control.
12) The only applicable law is the law of the Federal Republic of Germany. Should individual terms of the above eligilibity requirements become null and void, the remaining terms shall remain intact and in effect.
